Some factors are objective such as the age, education, and ability of each spouse to be self-supporting. Other factors are less objective such as whether there are convictions for acts of domestic violence by one spouse towards the other, whether either party is cohabiting with a person of the opposite sex, and such other factors specific to the case that the court determines just and equitable.

Organ Donation

A Proposed Simple Solution to the Shortage of Donor Organs

Far too often the news reports stories of shortages of donor organs. There is usually a tragic story of someone waiting too long on a list for a life saving organ. Sometimes, it is suggested that we enter a capitalistic/market approach and allow people to sell their organs. While this should be allowed, there is another solution that, in my opinion, promises an abundance of organs.

My solution to the shortage of donor organs involves an application of the golden rule. Briefly, we divide all Americans, without need for any exception, into two lists: A and B. To be on the A list you must agree to donate your organs upon your death. The donation includes medical research and well as transplants. This is voluntary. The B list is everyone else (i.e. people who do not wish to donate their organs).

The people on the A list have an Absolute Priority to receive an organ over the B list people, regardless of the condition of the patient. Remember, the B list people are receiving more than they are willing to give, even in their inferior position to the A list people. B list people may not receive an organ if there is an A list person who can use it.

Clearly, it is advantageous to be on the A list. If someone has a religious objection to donating their organs, then this systems allows them to practice their religious restriction and still potentially receive the benefit of an organ from someone more generous than himself.

Further, because the program provides for medial research, there is no need to establish any exceptions. Someone who would not be a candidate to donate an organ to a living recipient need not be given a pass. They still must donate their organs. This adds the beauty of treating everyone the same. As most people would prefer to be on the A list, the supply to organ would out pace the demand.

Finally, if the B listers to do not receive organs in time to save them, the survivors can console themselves with the knowledge that B listers would not have provided life saving gifts of their organs and therefore should not be heard to cry about the shortage.
